  • Mediation is a voluntary, confidential and non-binding process where a third-party, neutral mediator assists parties in resolving disputes by reaching a mutually acceptable resolution. At Iguana Law, our team acts as both mediators and party counsel for mediations.

    • Pre-Mediation:

      • Assess the case, suitability for mediation and define client objectives. 

      • Educate clients on the mediation process, their rights and obligations and potential outcomes. 

      • Prepare relevant documents and evidence to support discussions and strengthen the client’s position. 

    • During Mediation:

      • Provide legal advice without disrupting the collaborative nature of mediation. 

      • Help clients navigate discussions, making sure they don’t accept unfair and one-sided agreements under pressure. 

      • Assist in structuring settlement proposals and counteroffers. 

      • Ensure compliance with relevant mediation rules and regulations. 

    • Post-Mediation:

      • Review and draft the mediation settlement agreement.

      • Ensure enforceability and legal compliance of the agreement including making court filings where necessary.

      • Assist with implementation and follow-up legal formalities such as amending the existing contracts or drafting new contracts.

      • Address any breaches or non-compliance with the agreed settlement.

      • If mediation fails, advise clients on further legal options, including litigation or arbitration.

  • Arbitration is a voluntary, confidential, and either legally-binding or advisory dispute resolution process where a single arbitrator or an arbitral panel hears evidence and issues a decision. At Iguana Law, our team acts as legal counsel to represent clients in arbitration cases. 

    • Pre-Arbitration:

      • Analyse or draft arbitration agreements and arbitration clauses in contracts.

      • Prepare case strategies, gather evidence, and secure witness testimonies.

      • Guide selection of arbitrators, arbitration institutions and arbitration rules (e.g., ICC, UNCITRAL), where applicable.

    • During Arbitration:

      • Submission of written arguments, presentation of oral arguments and evidence before the arbitral tribunal.

      • Cross-examine witnesses and counter-oppose claims.

      • Ensure procedural compliance with relevant arbitration laws and rules.

    • Post-Arbitration:

      • Review the arbitral award and advise on enforcement in court if a party fails to comply. 

      • Challenge the award if there are grounds for appeal (if permitted). 

      • Assist in international arbitration enforcement under treaties like the New York Convention.

    • Post-Negotiation:

      • Ensure enforceability and compliance with applicable laws.

      • Assist in dispute resolution if the other party breaches the agreement.
